Kate Steinle's Killer Deemed Not Competent To Stand Trial For Her SF Death

The illegal immigrant acquitted in the killing of Kate Steinle in 2017 is not competent to stand trial. Judge Vince Chhabia issued the ruling Friday in the second trial of Jose Inez García-Zárate. Federal prosecutors had charged him with two felony counts of gun possession and being in the country illegally in the aftermath of his acquittal in Steinle murder case.

Judge Chhabia ruling was based on the finding of a mental health evaluation report which shows García-Zárate has an untreated mental illness. Lawyers for both sides can dispute the report's conclusions. If so, the court could explore attempts to "restore" him to competency through medication.
